I hereby take action for myself, and my executors, administrators, heirs, next of kin, successors, and assigns as follows:

I hereby release Kinchel S.A acting as Dynamic DMC Costa Rica, their affiliates, subsidiaries, officers, directors, employees, agents and representatives ( hereinafter the “Releases”) from any and all liability (including but not limited to, liability arising from the negligence or fault of the Releasees), claims, damages, costs, and expenses, including, but not limited to, personal injury, property damage or wrongful death. This includes, without limitations, any claims, damages or actions arising or resulting from the ordinary negligence of releasees. I hereby agree to waive any and all such claims and declare that this Waiver and Release is to be binding upon my heirs, executors, administrators, next of kin, successors and assigns.

I agree to indemnify each of the Released Parties and hold each of them harmless from any and all liabilities or claims made as a result of my participation in the activities and promotions of Releasees, and hereby promise not to sue any of the Released Parties for any injuries or damages resulting from my participation in the activities and promotions offered by Dynamic DMC.

I fully understand that I forever give up any right to sue or make claim against the releasees if I suffer injury or damage even though I do not know what or how extensive the injury or damage may be. I hereby personally assume all risks, whether foreseen or unforeseen, in connection with the activities and activities incidental thereto. I fully understand and agree that these terms are contractual and not a mere recital and that I have voluntarily signed this document.

I hereby acknowledge that I have read the Waiver and Release and I fully understand the terms and their legal effects and my signing constitutes release of valuable rights.

Important: In case of any accident, if you need medical assistance, the for you to attend a the medical facility covered by our supplier’s insurance for a professional check and follow necessary indications. If you believe that medical assistance is not necessary, you release Dynamic DMC and their affiliates, subsidiaries, officers, directors, employees and agents and representatives from any and all claims, damages, costs, and expenses.

This apply all activities, events, functions and tours, that I do with Kinchel Sociedad Anónima acting as Dynamic DMC Costa Rica.
